These Terms of Service ("Terms") govern your use of the COMEBACK Athlete mobile application ("Comeback"), website, and related services (collectively, the "Services").
By using COMEBACK, you agree to these Terms. If you do not agree, do not use the Services.
Please read these Terms carefully.
COMEBACK Athlete is independently operated by Theo Dunk in Illinois, United States.
COMEBACK provides recovery tracking, athlete progress tools, educational resources, athlete community features, and recovery support for athletes and their families.

You must be at least 13 years old to use COMEBACK.
If you are under 18 years old, you should have permission from a parent or guardian.
By using the Services, you represent that you meet these requirements.
You may create an account using Sign in with Apple, Google Sign-In, or email and password. Where other third-party or social login options are offered, Sign in with Apple is also available.

COMEBACK reserves the right to suspend or terminate accounts that violate these Terms.

Subscriptions are billed through Apple. Payment is charged to your Apple ID account at confirmation of purchase and again at the start of each renewal period.
Subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
You may manage or cancel subscriptions in your Apple ID account settings after purchase (Settings → [your name] → Subscriptions on iOS).
Refund requests for App Store purchases are handled by Apple under Apple’s applicable refund policies.
Subscription availability, pricing, trials, introductory offers, and included features may change and will be presented in the app and/or App Store product page before purchase.
Any unused portion of a free trial, if offered, may be forfeited when you purchase a subscription, where allowed by Apple.
COMEBACK is a wellness and educational product only. It is not a medical device and does not provide medical advice, diagnosis, treatment, emergency services, or return-to-play clearance.
COMEBACK does not provide:
Recovery scores, recommendations, and educational materials are informational only.

COMEBACK may use automated filters, review reports, remove content, block or restrict users, and suspend accounts at its discretion.
Users can report offensive content and block abusive users from the community experience.

COMEBACK, Comeback Progress, Comeback Signal, COMEBACK DAY, Athlete Network, Weekly Score, Parent Dashboard, and related branding are the property of COMEBACK.
You receive a limited, personal, non-transferable license to use the Services.
You may not reproduce or distribute app content without permission.

You retain ownership of your content.
By submitting content, you grant COMEBACK permission to display, store, moderate, and use that content for operating, protecting, and improving the Services.
COMEBACK may use:

COMEBACK is not responsible for third-party services.

Before filing legal claims, users agree to contact COMEBACK and attempt informal resolution.
Disputes that cannot be resolved informally may be resolved through binding arbitration where permitted by law.
These Terms are governed by the laws of the State of Illinois.
Any disputes not subject to arbitration shall be resolved in Illinois.
If you downloaded COMEBACK from the Apple App Store, the following additional terms apply and are intended to satisfy Apple’s Licensed Application End User License Agreement expectations for custom terms:
These Terms are an agreement between you and COMEBACK (operated by Theo Dunk) only, not with Apple Inc. ("Apple"). COMEBACK, not Apple, is solely responsible for the Licensed Application and its content.
Apple has no obligation to furnish any maintenance or support services for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession and/or use of the app, including but not limited to:
You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms and the Privacy Policy constitute the entire agreement between you and COMEBACK.
If any provision is unenforceable, the remaining provisions remain effective.
Failure to enforce any provision does not waive future enforcement.
